Drug company BismanOnline is suing the government over its decision to block access to recreational drugs
Bisman Online Inc., the nation’s largest online marijuana company, is suing a federal government agency that blocked it from operating a recreational marijuana marketplace, the Wall Street Journal reported Friday.
The lawsuit filed in the U.S. District Court for the District of Columbia alleges the Drug Enforcement Administration (DEA) discriminated against Bisman, which was based in California, by refusing to allow it to operate as a recreational cannabis marketplace.
Bisman’s complaint accuses the DEA of discriminating against the company, which had operations in California and Florida, for not complying with the federal law barring the sale and use of recreational marijuana in the states where it operates.
The DEA’s refusal to allow Bisman to operate a recreational marketplace violated the federal Controlled Substances Act (CSA), which prohibits interstate commerce in controlled substances.
BahanOnline had been authorized to operate in states that permit marijuana for medical use, such as Oregon, Washington, Alaska, Colorado, Nevada, Oregon, Massachusetts and California.
The company had hoped to expand its sales into the United States, but in the months following the election of Donald Trump, Bisman told investors it could not continue to sell in states where marijuana remains illegal.
In a statement to the Journal, Bahan said the lawsuit “is an unfortunate step in an ongoing effort to deny the American people the benefits of safe and legal marijuana for recreational use.”
The DEA declined to comment on the lawsuit.
A DEA spokesman did not immediately respond to a request for comment.
A 2014 federal appeals court ruling in a case that led to the ruling against the DEA barred states from enacting any laws that require the sale or use of marijuana for any reason other than for medical purposes.
Bisioun’s lawsuit says the DEA “ignored the harm that such a prohibition would cause to marijuana consumers, their families, and the state, including its effects on its own regulatory structure and enforcement efforts.”
The U.N. Committee Against Torture, which represents Bisiou, told the Journal that Bisiun has the right to use its lawsuit as a tool to “express its concern at the lack of progress on the federal government’s position.”
It said Bisiaun was not aware of the DEA’s position at the time of its decision, and it will continue to monitor the issue.
